Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 14-12-2021 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek regular bail in connection with Maheshkhunth P.S. Case No. 109 of 2020 instituted for the offences under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code read with Section 27 of the Arms Act. Learned counsel for the petitioners submits that the petitioners are in custody since 13.04.2021 and charge-sheet has been submitted in the case.

Learned counsel for the petitioners submits that from bare perusal of the allegation as alleged in the F.I.R. it would manifest that allegation of firing is against Gopal Singh who is

No.44298 of 2021(2) dt.14-12-2021 2/2 alleged to have fired aiming at the chest of the informant but missed and hit on his left hand causing entry and exit wound and as far as these petitioners are concerned, they are not alleged to have fired nor any overt act has been alleged against them rather they are alleged only with the allegation that they were also present at the place of occurrence. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.

Considering the fact that the petitioners are in custody since 13.04.2021 and charge-sheet has been submitted in the case, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of Smt. Ankita Jaiswal, learned Judicial Magistrate 1st Class, Khagaria in connection with Maheshkhunth P.S. Case No. 109 of 2020 subject to the condition as laid down under Section 437 (3) Cr.P.C.
