Petitioners are in custody in connection with Paraiya P.S. Case No. 56 of 2019 for the offence under section 30(a) of the Bihar Prohibition & Excise Act, 2016.

Learned counsel for the petitioners submits that petitioner no.1 is lady and petitioner no.2 has no criminal antecedent.

In the instant case 40 liters of mahua wine was seized. Petitioners are in custody since 6.4.2019.

Considering the fact that petitioner no.1 is lady and petitioner no.2 has no criminal antecedent, the Court is inclined
