2. The petitioner apprehends arrest in a case registered under Sections 30(a) of Bihar Excise Act.

3. As per the prosecution case, there is recovery of 18 litres of foreign liquor from the pile of wood situated in front of the house of this petitioner.

4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Petitioner has no concern with the seized liquor. The alleged recovery has been made from an open place easily accessible to anyone. It is further submitted that petitioner was neither present on the place of occurrence and never involved in

Patna High Court CR. MISC. No.32852 of 2025(2) dt.20-05-2025 2/2 the alleged occurrence. Petitioner has no criminal antecedent and he undertakes to cooperate in the investigation and trial.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount to each to the satisfaction of the learned Exclusive Special Excise Court-II, Motihari, East Champaran in connection with Excise P.S. Case No. 159 of 2021, subject to the conditions as laid down under Section 482(2) of the B.N.S.S., 2023.
