The petitioner seeks bail in connection with Rajgir P.S. Case No. 245 of 2015 registered under Sections 399, 402 of the Indian Penal Code and 25(1-B)(a), 26 and 35 of the Arms Act.

It is submitted by the learned counsel for the petitioner that similarly circumstanced another co-accused Ram Kewat @ Sri Ram Kewat has already been granted bail by a coordinate Bench of this Court vide order dated 22nd April, 2016 passed in Cr. Misc. No. 13753 of 2016. It is further submitted that the petitioner is languishing in jail since 8th December, 2015

Patna High Court Cr.Misc. No.21825 of 2016 (2) dt.20-05-2016 2 / 2 and the only allegation against him is that two cartridges were recovered from his possession.

Regard being had to the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif in connection with Rajgir P.S. Case No. 245 of 2015.
