JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 23-05-2016 The petitioner apprehends his arrest in relation to Buxar Industrial Area P.S. Case No. 04 of 2016 registered under Sections 307/302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation by the informant is that some other persons other than the petitioner come and shot his brother at close range. Petitioner has been named in the subsequent statement as made by the informant in course of investigation. He submits that the petitioner is known to the informant, yet he was not named in the First Information Report.

Considering the aforesaid facts, till submission of charge sheet, the petitioner in the event of his arrest/surrender before the court below within four weeks, let the petitioner, above

No.22017 of 2016 (2) dt.23-05-2016 2/2 named be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar, in connection with Buxar Industrial Area P.S. Case No.04 of 2016 (G.R. Case No. 38 of 2016), subject to conditions laid down under Section 438(2) of the Code of Criminal Procedure. If the petitioner is charge sheeted then he would be required to surrender before the trial court and pray for bail, which would be decided by the trial Court upon the material available in the case diary, without being prejudiced in any manner, by order of this court.
