The petitioner is in custody in a case registered under Section 376 and other allied Sections of the Indian Penal Code and 66,66(A),66(D) and 67(B) of I.T.Act It is alleged by the informant that he had been receiving information since last week that video footage of blue film was being displayed through whats app on mobile. It is further alleged that one boy along with girl putting in a naked position was prepared for the purpose of blue film. The girl was being assured that Video footage of naked position will not be shown to any person. It is further alleged that room no.101 of

Patna High Court Cr.Misc. No.27513 of 2015 (2) dt.31-07-2015 2/2 Sidharth Hotel-cum-Food Plaza Restaurant is the place of occurrence. The informant and other police officials raided the aforesaid place of occurrence. The petitioner was interrogated and confessed the alleged occurrence.

It is submitted on behalf of the petitioner that the petitioner is in custody since 4.5.2015.The petitioner is said to be the Manager of the hotel, in question. Further it is submitted that the petitioner has been made accused in this case due to mistake of fact. It is also submitted that the petitioner may be released after completion of seven months in custody from 4.5.2015. On behalf of the State, it is submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail, after completion of seven month in custody from 4.5.2015, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Seikhpura in Sheikhpura P.S.Case No.121 of 2015.
