JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-07-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.

One unknown dead body was recovered and the present case was lodged against unknown on the basis of report of Chowkidar. In course of investigation, the dead body was identified and it came to light that deceased had sweet relation with one Sufiya. It also came to light that husband of aforesaid Sufiya as well as other relatives managed the petitioner and others and got eliminated the deceased. The name of petitioner came in confessional statement of co-accused, Md. Nizamuddin and it

Patna High Court Cr.Misc. No.23646 of 2016 (3) dt.14-07-2016 2/2 appears that except the aforesaid confessional statement, there is nothing against the petitioner. Moreover, having more or less similar allegation, co-accused, Saukat @ Md. Saukat and Md. Rashid, who happens to be husband of Sufiya, have already been granted privilege of bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 3rd Additional Sessions Judge, Bhagalpur in connection with Sessions Trial No. 208 of 2016 arising out of Kajraili P.S. Case No. 44 of 2015.
