The petitioner seeks bail in a case registered for the offence punishable under Sections 399, 402 of IPC and 25(1-AA), 26, 35 of the Arms Act.
Allegation is that the petitioner and others were apprehended by the police and from possession of the petitioner three live cartridges of 9 mm, one mobile set, a Bajaj Pulzar motorcycle, two live cartridges of A. K. 47 and five live cartridges of 7.33 bore were recovered.
It is submitted that the mobile set and the motor cycle belong to the petitioner. The petitioner has been in custody since 4.2.2015. It is also submitted that in similar facts and
Patna High Court Cr.Misc. No.27753 of 2015 (2) dt.10-08-2015 2/2 circumstances, co-accused Sahil Kumar @ Lopi has been granted bail by this Court vide Cr. Misc. No. 23717 of 2015. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of Smt. Rashmi Prasad, Judicial Magistrate, 1st Class, Patna/court concerned in Beur P. S. Case No. 22 of 2015 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
