The petitioner has filed this petition for transfer of Misc. Case No.5 of 2013/98 of 2014 from the court of Principal Judge, Family Court, Darbhanga to the court of Principal Judge, Family Court, Saran at Chapra. The Misc. Case is filed to set aside the judgment and decree passed ex parte by the Principal Judge, Family Court, Darbhanga. The ex parte judgment and decree can be set aside by the same court and, therefore, I find no reason to transfer the miscellaneous case from the court of Principal Judge, Family Court, Darbhanga to the court of Principal Judge, Family Court, Saran at Chapra. Accordingly, this petition is dismissed with a direction to the Principal Judge, Family Court, Darbhanga to dispose of
