JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-08-2016 Both the above-said petitions arise out of Dhanaura P.S. Case No. 72 of 2016 registered under Sections-395 & 397 of the Indian Penal Code and accordingly, both the above-said petitions are being heard and disposed of by this common order. Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State.

Patna High Court Cr.Misc. No.22024 of 2016 (5) dt.30-08-2016 2/2 Petitioners are not named in the first information report but from perusal of the impugned order, I find that name of these petitioners surfaced in course of investigation in confessional statement of co-accused and, except aforesaid confessional statement of co-accused, there appears to be nothing against the petitioners. Petitioners are languishing in jail custody since long and, moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail by a Co-ordinate Bench of this Court.

Accordingly, petitioners named above, are directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Dhanaura P.S. Case No. 72 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Masaurhi.
