The petitioner is languishing in custody since 21-06-2018 in a case registered for the offences punishable under Sections 25(1-B) a, 26 and 35 of the Arms Act.

It is alleged that from the possession of petitioner Sohan Thakur three mobile phones, three live cartridges of 9 MM were recovered.

It is submitted by learned counsel for the petitioner that he has falsely been roped in the present case and though the petitioner is accused in three other cases, but he is on bail in all those cases.

Learned APP submits that recovery of live cartridges have been made from the petitioner and he is named in the FIR.

No.34666 of 2019(2) dt.28-05-2019 2/2 Considering the nature of recovery, the fact that the investigation has already been concluded and the period under custody, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Patna, in connection with Digha P.S. Case No. 322 of 2018.
