In this case the petitioners are seeking bail in Motipur P.S. Case No. 41 of 2015 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307, 448 and 376/511 of the Indian Penal Code.

As per the First Information Report allegation has been made that on 06.03.2015 the accused persons entered into the courtyard and started misbehaving with the wife of informant as well as the wives of his younger and elder brother. When it was objected, the accused persons returned and after ten minutes they came along with 33 persons with arms and allegation has been made that all the persons have assaulted by rod, sword and other

Learned counsel for the petitioners submits that on the same day the petitioners also lodged First Information Report vide Motipur P.S. Case No. 42 of 2015 and Motipur P.S. Case No. 45 of 2015. On perusal of both the First Information Reports, it seems that similar type of allegation has been made. It is further submitted that they are the agnates and the case and the counter case has been filed on account of the land dispute. Looking to the facts and circumstances of the case, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Subdivisional Judicial Magistrate (West), Muzaffarpur in connection with Motipur P.S. Case No. 41 of 2015.
