The petitioner seeks bail in anticipation of his arrest in connection with Dhaka P.S. Case No. 92 of 2019, dated 21.03.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. One vehicle was intercepted from where Nepalese
Patna High Court CR. MISC. No.32962 of 2020(2) dt.03-03-2021 2/2 liquor (873 litres) was recovered. The arrested accused persons, viz., Md. Naushad disclosed before the police that the petitioner and the owner of the vehicle, viz., Harendra Mahto were escorting the vehicle. On the basis of the aforesaid confession of arrested accused person, the present litigation has brought about against the petitioner. The petitioner does not have criminal antecedents. Regard being had to the facts afore-stated, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, East Champaran, Motihari in connection with Dhaka P.S. Case No. 92 of 2019, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
