JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 26-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

The petitioner seeks bail in a case for the offences punishable under sections 409, 34 of the Indian Penal Code and 25(I-B) 26, 35 of the Arms Act.

It is a case of misuse of privilege of bail as the bail bond of the petitioner was cancelled on 15.11.2011 and thereafter, the petitioner has been apprehended and is in custody since 31.3.2016.

Submission is of false implication and that in furture the petitioner shall not misuse the privilege of bail and will remain vigilant.

In the facts and circumstances stated above,

Patna High Court Cr.Misc. No.22794 of 2016 (2) dt.26-05-2016 2/2 considering the detention of the petitioner, now he is directed to be released on bail on execution of bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada in connection with Kawakola P.S. Case No.79 of 2000, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
