The petitioner apprehends his arrest in Town P.S. Case No. 286 of 2020, registered for the offences punishable under Section 307 and other allied sections of the Indian Penal Code. As per the prosecution case, this petitioner assaulted the husband of informant on his chest with fist and slaps, as a result of which he sustained injury.

It is submitted that there is case and counter case. Informant's husband is own younger brother of petitioner. Both parties are residing in same house and due to property dispute a title suit bearing T. S. No.-207 of 2020 is pending before the Court of Civil Judge-I, Darbhanga and to put pressure upon the petitioner this false case has been lodged.

However, counsel for the informant vehemently

Patna High Court CR. MISC. No.45445 of 2021(3) dt.11-07-2022 2/2 opposed the prayer for bail and submitted that accused petitioner assaulted the husband of informant and the doctor has found the injury to be grievous in nature. Petitioner has got criminal antecedent of four cases.

Considering the nature of injury and criminal antecedents of the petitioner, I am not inclined to enlarge the petitioner above-named on anticipatory bail. Accordingly, the same is rejected.
