The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 341, 323, 324, 325, 379, 504, 506 and 34 of the Indian Penal Code. As per the prosecution case, it is stated that the four named accused persons including the petitioner herein, over a dispute between the parties, the petitioner assaulted the son and the husband of the informant leading to serious injuries. It is submitted by learned counsel appearing for the petitioner that the petitioner has been falsely implicated in the case. The disputing parties are gotias of each other. The manner of occurrence is other than what has been alleged in the FIR. Even accepting the allegations in the FIR, it is submitted that so

No.45259 of 2021(4) dt.21-03-2022 2/2 far as the injury on Sri Krishna Pandit is concerned, the same was found to be simple in nature and one of the injuries on Pramod Kumar Pandit which was found to be grievous in nature has not been attributed to this petitioner and is said to be on ulna (hand). The petitioner is in custody since 4.6.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation, the injury reports together with the petitioner having remained in custody for over 9 months, the petitioner is directed to be enlarged on bail in connection with Belhar P.S. Case no. 335 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate/successor court, Banka.
