The petitioner, who seeks bail in a case registered for the offence punishable under Sections 302, 201/34 of IPC, is in custody since 15.4.2014.
It is submitted that the FIR was lodged against unknown. The name of the petitioner has appeared in the confessional statement of co-accused Ajit Singh. The petitioner was living outside, as such, he could not know about his alleged involvement in that crime.
It is further submitted that co-accused Ajit Singh was tried and he was acquitted. Trial of co-accused Raj Kishore Singh is going on vide Sessions Trial No. 451 of 2006 and he has been
Patna High Court Cr.Misc. No.29517 of 2015 (2) dt.12-08-2015 2/2 granted bail. The petitioner has no criminal antecedent. Considering the facts and circumstances, the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur/ court concerned after framing of charge in Mahua P. S. Case No. 24 of 2003 with following conditions:-
1. The petitioner will not indulge himself in similar or any other offence.
2. One of the bailors must be the close relative of the petitioner.
3. The petitioner will be well represented in the Court on each and every date and in case of absence for two consecutive dates or in case of violation of terms of bail, his bail bond would be liable to be cancelled by the learned Court concerned.
