Ms.Meena Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 01-06-2026 Heard Mr. Abhishek Anand, learned Advocate for the petitioners and Ms. Meena Singh, learned Additional Public Prosecutor for the State through virtual mode.
2. The petitioners apprehend their arrest in connection with Kusheshwar Asthan (K. Asthan) P.S. Case No. 63 of 2025, registered for the offences punishable under Sections 126(2), 127(2), 115(2), 118(1), 110, 352, 351(2), 3(5) of the BNS.
3. Allegedly, on the fateful day while the work of road construction was going on in front of the house of the informant,
2/4 in the meanwhile, on account of some dispute the petitioners along with others armed with stick, farsa and iron rod came there and on the exhortation made co-accused Lachhi Yadav, Dasrath Yadav assaulted the informant by means of farsa. It is further alleged that co-accused Ramakant Yadav also assaulted him by means of iron rod over his head, whereupon the petitioners have pelted stones over the house of the informant and destroyed the same.
4.Learned Advocate for the petitioners submitted that so far the petitioners are concerned, there is allegation that they pelted stones over the house of the informant and destroyed the asbestos roof and there is no specific allegation against them of causing any injury. Moreover, the injuries which are allegedly sustained to the informant is concerned, the same is found to be simple in nature as the police has submitted chargesheet under Section 110 of the BNS. It is further contended that the alleged occurrence took place on 09.03.2025, however, the present FIR came to be instituted on 12.03.2025 and as such the false implication of the petitioners cannot be ruled out. The parties are also on litigating terms and there is pending Title Suit No. 199 of 2015. Co-accused persons Lachchi Yadav @ Lachchhi Yadav and Rama Kant Yadav have already been extended the
3/4 privilege of anticipatory bail by the coordinate Bench of this Court in Cr. Misc. No. 8429 of 2026. The petitioners are men of fair antecedent and they undertake that they will fully cooperate in the proceeding of the court.

On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioners have actively participated in the crime and moreover the prayer for anticipatory bail of co-accused Dasrath Yadav @ Dashrath Kumar Yadav has been rejected by the coordinate Bench of this Court.

Having considered the submissions advanced by the learned Advocates for the respective parties and taking note of the nature of allegation levelled against the petitioners, besides the factum of previous dispute as also the fact that the chrgesheet has been submitted under Section 110 of the BNS along with other allied sections and the injury is a result of free fight as also the fact that other co-accused persons having identical allegation have been allowed the privilege of anticipatory bail by the co-ordinate Bench of this Court, let the petitioners abovenamed be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this
4/4 order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Biraul, Darbhanga in connection with Kusheshwar Asthan (K. Asthan) P.S. Case No. 63 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioners.
