The petitioner seeks bail in connection with Chapra Mufassil P.S. Case No. 06 of 2016 registered under Sections 341, 323, 379 and 307/34 of the Indian Penal Code. It is contended by the learned counsel for the petitioner that the only allegation against the petitioner is that he assaulted with rod on the informant causing one injury, which is simple in nature. It is further contended that even if the entire allegations made in the FIR are taken to be true, the ingredients of the offence under Section 307 of the Indian Penal Code would not be attracted.

Be that as it may, regard being had to the facts and

No.21682 of 2016 (2) dt.19-05-2016 2/2 circumstances of the case, the petitioner Arun Rai, who is in custody since 1st April, 2016, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Chapra in connection with Chapra Mufassil P.S. Case No. 06 of 2016.
