In this case, the petitioner is seeking bail in connection with Shastri Nagar P.S. Case No. 132 of 2016 registered for offences under section 384 of the Indian Penal Code. Allegation has been made that the petitioner and other two accused persons were threatening and coercing the informant to withdraw from the tender, otherwise he would face the dire consequences.

The counsel for the petitioner submits that the petitioner is an employee of C.P.W.D. for last 27 years, having no criminal antecedent and the mobile by which the victim was given the threatening was of Mantu Sharma and Shambhu Sharma, has

Co-accused, Anil Kumar @ Anil Kumar has already been granted bail by this Court in Cr. Misc. No. 20658 of 2016 and Ashok Kumar has also been granted bail in Cr. Misc. No. 20276 of 2016.

Looking to the facts and circumstances of the case, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Aditi Gupta, Judicial Magistrate 1st class, Patna in connection with Shastri Nagar P.S. Case No. 132 of 2016, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner (ii) if the petitioner is found involved in future in similar type of case, the prosecution will be at liberty to make prayer for cancellation of his bail and the court below will pass necessary order, including cancellation of bail and (iii) the petitioner would cooperate in the proceeding of the court below.
