JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 366A, 370, 372, 373 of the Indian Penal Code and Sections 9, 10, 11 of Child Marriage Act, 2006.

Petitioner was caught along with others while he was going to solemnize his marriage with a minor girl. The victim girl specifically stated in her statement recorded under Section 164 of the Cr.P.C. that it was Meena Devi, who forced her into the above stated marriage. Moreover, petitioner is in jail custody since 03.03.2016 and one co-accused, Moti Ram has already been granted privilege of bail.

Case No. 130 of 2016.
