2. The petitioner has preferred this application for grant of regular bail in connection with Isuapur P.S. Case No. 42 of 2025 dated 28.02.2025 registered for the offences punishable u/ss 310(4), 310(5), 317(4), 317(5) of the B.N.S. and u/s 25(1B)(a), 26 and 35 of the Arms Act and Section 30(a) of the Bihar Prohibition and Excise Act.

As per the prosecution case, on a secret information, the informant along with the police personnel reached the place of occurrence and apprehended four accused persons who were planning to commit crime. On search, an automatic loaded pistol having two live cartridges, mobile

From the co-accused, Suraj Kumar, cash of Rs. 1,20,000/- and a mobile phone were recovered. Two live cartridges, mobile phone and cash were recovered from the possession of the co-accused, Ravindra Kumar and from possession of the co-accused, Arman Babu, two live cartridges, knife, 54 gram charas and a motorcycle were recovered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. The petitioner is not named in the F.I.R. The name of the petitioner has sprung up in the confessional statement of the co-accused, Deepranjan Kumar. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery rather the recovery has been made from the accused persons named in the F.I.R. The coaccused person has already been granted bail by this court vide order dated 30.04.2025 passed in Cr. Misc. No. 27261/2025. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 31.03.2025.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Saran in connection with Isuapur P.S. Case No. 42 of 2025.

7. The application stands allowed.
