JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395 & 397 of the Indian Penal Code. Petitioner is not named in the first information report which was lodged against unknown persons in connection with a train dacoity. The name of this petitioner surfaced in this case in course of investigation and subsequently, he was arrested and confessed his guilt, disclosing his guilt. It appears that except the aforesaid confessional statement as well as some criminal antecedent, there is nothing against the petitioner. The petitioner is languishing in jail custody since 10-01-2016.

Patna High Court Cr.Misc. No.20342 of 2016 (2) dt.13-05-2016 2/2 Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Sugauli (G.R.P.) Rail P.S. Case No. 37 of 2015 to the satisfaction of learned Judicial Magistrate (Rail), Bettiah, West Champaran.
