JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 25-05-2016 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.
The petitioner seeks bail in a case for the offence punishable under section 392 of the Indian Penal Code. The first information report is lodged against three unknown miscreants. During investigation, the name of petitioner transpires in confessional statement of two co-accused, namely, Sandeep and Lal Babu Mian.
Submission is of false implication and that besides confessional statement of co-accused, there is no other legal material against the petitioner, the petitioner was arrested in Derni P.S. Case No.120 of 2015 wherein he has been granted bail by the learned court below itself and thereafter, he has been remanded in
Patna High Court Cr.Misc. No.22510 of 2016 (2) dt.25-05-2016 2/2 this case on 5.2.2016 and since then he is in custody, he has not been put on T.I. Parade, nothing has been recovered from his possession and charge sheet has already been submitted. The learned A.P.P. submits that it is a case of road robbery wherein motorcycle and cash of Rs.12,000/- was snatched from the informant.
In the facts and circumstances stated above, the petitioner, above named, is directed to be released on bail on execution of bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.-IX, Saran at Chapra in connection with Taraiya P.S. Case No.259 of 2015, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
