It appears from the material, available on the record that prior to filing of the Complaint Case No. C-1 1548 of 2011, Runnisaidpur P.S. Case No. 164 of 2010 and Runnisaidpur P.S. Case No. 09 of 2011 were registered. Runnisaidpur P.S. Case No. 164 of 2010 was registered against unknown whereas; Runnisaidpur P.S. Case No. 09 of 2011 was registered on the basis of complaint petition and in the aforesaid complaint petition, petitioner was shown as an accused. Furthermore, it appears that police

Patna High Court Cr.Misc. No.33718 of 2015 (2) dt.19-08-2015 2/2 submitted final form in both the cases and, thereafter, protest petition was filed and the protest petition was taken as complaint petition and after inquiry, the petitioner was summoned to face trial.

Considering the aforesaid facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Complaint Case No. C-1 1548 of 2011 to the satisfaction of Learned Chief Judicial Magistrate, Sitamarhi.
