2. The petitioner seeks regular bail in connection with Katihar Nagar P.S. Case No. 803 of 2024 dated 01.11.2024 instituted for the offences punishable under Sections 331(4) and 305 of the B.N.S., 2023.
3. As per the prosecution story, the house of informant was robbed on 01.11.2024, in which 90 gm gold ornament, Rs. 1,50,000/- cash, 350 gm silver ornament and 20 old silver coins were taken away by the unknown thieves. It is further alleged that door lock of tenant's room of the informant was found broken and two mobile phones were recovered from that room.
4. Learned counsel for the petitioner submits that
Patna High Court CR. MISC. No.33335 of 2025(2) dt.26-05-2025 2/3 petitioner is innocent and has falsely been implicated in this case. FIR is lodged against unknown person and name of petitioner transpired in this case on the basis of confessional statement of co-accused Md. Juber @ Haddi. No incriminating article has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 10.12.2024; but, in the impugned order it is mentioned that petitioner is in custody since 10.12.2025, which appears to be typographical error. He lastly submits that after completion of investigation, chargesheet has been submitted against the petitioner.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Having heard the learned counsel for the parties and considering the facts and circumstances of the case as well as petitioner's period under custody, this Court is inclined to enlarge the petitioner on bail after framing of charge, if not framed as yet. Accordingly, let the petitioner, above-named, be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Katihar in connection with Katihar Nagar P.S. Case No. 803 of 2024, on
Patna High Court CR. MISC. No.33335 of 2025(2) dt.26-05-2025 3/3 further conditions:
(i) One of the bailors should be close relative of the petitioner.
(ii) Petitioner shall cooperate in the trial and shall be present on each and every fixed date and on his absence on two consecutive dates without sufficient reason, his bail bond may be cancelled by the learned trial Court.
