JUSTICE PRABHAT KUMAR JHA ORAL ORDER 03-08-2015 As prayed for, learned counsel for the petitioners is permitted to make correction in the prayer portion of this Cr. Misc. petition during the course of the day.

The petitioners seek bail in a case under Section 307 and other Sections of the Indian Penal Code. Petitioner no.1 Sheo Shankar Yadav is alleged to have assaulted Kaushalya Devi with spear on her forehead and petitioner no.2 Bhagwat Yadav is alleged to have assaulted Saheb Yadav causing fracture injury on his hand. It is submitted that the Police after investigation found the case to be false against the petitioners. The injury which is said to have been caused by Sheo Shankar Yadav on the forehead of Kaushalya Devi, is simple in nature. The second injury sustained by Kaushalya Devi on her left ulna bone was caused by hard and blunt object. Learned counsel for the informant has opposed the prayer for bail and submitted that the injuries are grievous in

Considering the facts aforesaid and the fact that the petitioners are in jail since 21.5.2015, the petitioners above named are directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Washim Akram Khan, Judicial Magistrate 1st Class, Bettiah, West Champaran in Lauriya PS Case No. 137 of 2013.
