Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Kunauli P.S. Case No. 17 of 2021 registered for the offence punishable under Section 7 of the Essential Commodities Act. Learned counsel for the petitioner has submitted that the petitioner is the owner of the motorcycle, wherefrom 40 liters of kerosene oil has been recovered. He has submitted further that one Shambhu Nath Sah, is a dealer-cum-hawker, who took the motorcycle of the petitioner on the pretext that he

The petitioner gave his motorcycle in good faith and later on, he came to know that 46 liters of kerosene oil was recovered from his motorcycle. The petitioner is a person of clean antecedents. Considering the above mentioned facts and circumstances, as well as the clean antecedent of the petitioner, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Birpur Supaul in connection with Kunauli P.S. Case No. 17 of 2021, subject to condition as laid down under Section 438 (2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
