JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 11-01-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Phulwari Sharif P.S. Case No. 1114 of 2019, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

The petitioner is in custody since 26.12.2019. Allegedly, from his possession, the police recovered one country made pistol and two live cartridges. On perusal of the statement made in paragraph 3 of the application, it appears that petitioner has been implicated in 12 more cases. However, considering the circumstances that there is no allegation of use of firearm and possession is the only allegation and since the petitioner is in custody since

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IX, Patna, in Phulwari Sharif P.S. Case No. 1114 of 2019.
