JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 30-06-2016 Heard learned counsel for the petitioner and learned A.P.P. representing the State.

The petitioner seeks bail in connection with Lauriya P.S. Case No. 25 of 2016 registered for the offences punishable under Section 379 of the Indian Penal Code.

Allegedly, the petitioner stolen away motorcycle of the informant which was seen by Dhananjay Kumar.

Submission is of false implication and that only on the basis of statement of Dhananjay Kumar the petitioner has been implicated in this case, the petitioner is on inimical term with Dhananjay Kumar, the petitioner has been arrested in this case on 19.02.2016 and his confessional statement has been got recorded

Patna High Court Cr.Misc. No.20525 of 2016 (3) dt.30-06-2016 2/2 forcibly but nothing has been recovered from possession of the petitioner, without any fault the petitioner is suffering in custody. The learned A.P.P. submits that petitioner has got criminal antecedent as he is involved in one more case. In the facts and circumstances stated above, considering the custody of the petitioner, now the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Additional Chief Judicial Magistrate, Bettiah, West Champaran in connection with Lauriya P.S. Case No. 25 of 2016, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
