Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 420, 385, 387, 504 and 506 of the Indian Penal Code and Sections 66-C and 67 of the Information Technology Act, 2000, registered in connection with Muzaffarpur Sadar P.S. Case No. 707 of 2019. As per allegation, the petitioner made filthy clips of the informant and threatened to make viral the filthy clips. The learned counsel for the petitioner has submitted that the informant is a married lady and the petitioner is also a married person. Though there was some amicable relations between them and thereafter some dispute arose, but the parties have compromised the case subsequently. The informant does not want to pursue the case. Her husband Varun Kumar also advised her not to pursue the case. She wanted to lead her conjugal life in peaceful atmosphere.

Considering the above facts and circumstances, let

No.44706 of 2021(3) dt.04-07-2022 2/2 the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S.Case No. 707 of 2019, subject to the conditions as laid down under Section 438(2) Cr. P.C.

In future, if it is brought to the notice of the learned court below that the petitioner is involved in similar type of occurrence, the learned court below shall cancel the bail bond of the petitioner.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
