The petitioner seeks bail in connection with R/C Case No. 5/A/2018 corresponding to Special Case No. 1 of 2021, registered for the offence punishable under Section 420 and other allied sections of the Indian Penal Code and sections 13(2)/13(1)(c) and 13(1)(d) of the Prevention of Corruption Act. This case relates to Srijan Scam.
It is submitted on behalf of petitioner that at the relevant time petitioner was posted as Clerk, Bank of Baroda and the only allegation against the petitioner is that he filled up the pay-in-slips. Petitioner is neither the Chequer nor the passing authority. No loss has caused to the State Exchequer. Similarly situated co-accused have been granted bail by this Court. Petitioner has been remanded in this case on 27.01.2021.
Patna High Court CR. MISC. No.44486 of 2021(2) dt.22-01-2022 2/2 Chargesheet has already been submitted.
However counsel appearing on behalf of Central Bureau of Investigation opposed the bail application and submitted that there is sufficient evidence regarding the involvement of petitioner and there is allegation of illegal transfer of huge government money.
Considering the fact that chargesheet has already been submitted and similarly situated co-accused have been granted bail by this Court, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge CBI-II, Patna in connection with R/C Case No. 5/A/2018 corresponding to Special Case No. 1 of 2021.
