The petitioner is accused in connection with Siwan Muffail P.S. Case No. 38 of 2016, registered under Section 399, 402 and 414 of the Indian Penal Code and Section 25(1b)a/26/35 of the Arms Act. The accusation is that on receiving secret information about gathering of miscreants for preparation to commit heinous crime, the Police reached at Bahiyar near old brick-kiln. On seeing the Police party, six persons on three motorcycles started to flee away, but on chase the petitioner was apprehended. On search, one country made pistol along with one live cartridge and one motorcycle recovered from the possession of the petitioner, who also disclosed the name of other four persons.

Patna High Court Cr.Misc. No.20767 of 2016 (2) dt.18-05-2016 2/2 Learned counsel for the petitioner submits that the petitioner having no criminal antecedent is in custody since 07.02.2016. Further submission is that the said motorcycle, which is said to be recovered from the possession of the petitioner has already been released in favour of the father of the petitioner.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Siwan Muffasil P.S.
