1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Kundwa Chainpur Police Station Case No. 164 of 2020, dated 22.10.2020, disclosing offences under Sections 147/149/323/279/379/354/307/504/506/337/338 of the Indian Penal Code.

3. The prosecution case, as per the First Information Report, is that on 14.10.2020, co-accused Rahmt Alam was driving a tractor and dashed cousin brother of the informant and when the informant opposed he started abusing him. In the meanwhile, other accused persons,

No.40146 of 2025(2) dt.09-07-2025 2/3 total 21 named and 10 to 15 unknown, arrived there and assaulted the informant by means of lathi, danda, ironrod, etc. due to which the informant sustained injuries. The petitioners are amongst the 21 accused persons named in the First Information Report.

4. Learned counsel for the petitioners submits that allegations against the petitioners are general and omnibus in nature. He next submits that similarly situated co-accused persons, namely, Gufrana Khatoon @ Gufrana Begam and Afsar, have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 9773 of 2025 on 14.02.2025.

5. Having regard to the submissions made on behalf of the parties and taking into consideration the fact that similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioners privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs.

No.40146 of 2025(2) dt.09-07-2025 3/3 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate I, Sikarahana at Dhaka, East Champaran, Motihari, in connection with Kundwa Chainpur Police Station Case No. 164 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
