2. The petitioner is apprehending his arrest in connection with Rajauli P.S. Case No. 340/2021 for the offence under section 379 of the Indian Penal Code lodged on 07.07.2021 by the informant, Deepak Kumar.

3. As per the prosecution story, the informant alleged that he went to the hospital with his motorcycle but upon coming out, it was missing. This led to the FIR.

4. The investigation brought the case to the door of the petitioner and that is how he is before this Court for grant of anticipatory bail.

5. Though learned counsel for the petitioner tried to impress upon this Court his innocence, learned APP, Mr. Jitendra Kumar Singh submitted that he has criminal antecedent

Patna High Court CR. MISC. No.35068 of 2026(2) dt.20-05-2026 2/2 and the fact remains that the FIR was lodged in the year 2021 and he is seeking anticipatory bail after the delay of five years.

6. In that background, no relief can be extended to the petitioner.

7. Accordingly, the anticipatory bail application stands rejected.
