The petitioner seeks bail in Special Case No. 3353/2019, arising out of Kankarbagh P.S. Case No. 330/2019, instituted for offence under Section(s) 37(C) of the Bihar Prohibition and Excise Act, 2016 and Section 75 of J.J.B. Act. It is alleged in the written report that police got information that near Rental Flat 79 someone is beating his minor child brutally. The police went to the place of occurrence then this petitioner came out from inside. Smell of wine was coming from his mouth. In the meantime local people gathered there and they informed the police that petitioner used to beat his minor child. Thereafter the minor child was handed over to woman renter for safety purpose.

From the written report it appears that nobody has seen

Patna High Court CR. MISC. No.32343 of 2019(2) dt.15-05-2019 2/2 the assault committed by petitioner to his minor child. Aforesaid allegation has been levelled only on the basis of hearsay.

It is mentioned in para 3 of bail petition that one more case of Excise Act is pending against the petitioner. Petitioner is in custody since 27.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Patna, in connection with Special Case No. 3353/2019, arising out of Kankarbagh P.S. Case No. 330/2019, subject to the conditions that both the bailors shall be the close relative of the petitioner.

The petitioner will file affidavit at the time of filing bail bond that he would not indulge in such type of activity in future. In the event, he is found indulged in such type of activity, his bail bond in the instant case will liable to be cancelled. (Sanjay Priya, J) rakhi/- U T
