2. As prayed for, the case is dismissed as withdrawn with liberty to seek appropriate statutory remedy available to him before the District Magistrate, Rohtas at Sasaram.

3. The period of pendency of writ before the High Court shall be precluded by the District Magistrate for the purpose of limitation.
