The petitioners are seeking anticipatory bail in connection with Sakra P.S. Case No. 67/2019 registered under Sections 272 and 273 of the Indian Penal Code and Section 30(a), 35(a), 38, 41 of the Bihar Prohibition and Excise Act, 2016, pending in the court of learned special Judge, Excise Act, Muzaffarpur.
Learned counsel for the petitioners submits that name of the petitioners has been brought in this case on mere suspicion. The petitioners have clean antecedent and the coaccused similarly situated has been granted privilege of
Patna High Court CR. MISC. No.33682 of 2019(3) dt.08-08-2019 2/2 anticipatory bail by learned coordinate Bench of this court in Cr. Misc. 33406/2019.
Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioners, however it is submitted that name of the petitioners is based on suspicion. In the given facts and circumstances of the case, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioners be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Muzaffarpur, in connection with Sakra P.S. Case No. 67 of 2019, subject to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
