JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-01-2022 Heard learned counsel for the petitioner and the State. The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 366A and other ancillary sections of the Indian Penal Code and section 8 of the POCSO Act.

As per the prosecution case, petitioner enticed away 17 years old minor daughter of the informant. He has suspected that the petitioner might sale the victim to some other person or kill her.

Learned counsel for the petitioner submits that in 164 Cr. P. C. statement, the victim has stated that she is 20 years old and no one has kidnapped her and she left the house with her own accord because she was in love with the petitioner and now she has performed marriage with him and presently she is

Patna High Court CR. MISC. No.44357 of 2021(2) dt.21-01-2022 2/2 pregnant of 2 1⁄2 months. Petitioner is in custody since 17.4.2021.

Considering the aforesaid facts and circumstances of the case and the aforesaid statement of the victim, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge VI cum Special Judge, POCSO Act Sitamarhi in Bela Police Station Case No. 67 of 2021/Reg.No.1032 of 2021.
