JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be husband of the deceased. The marriage of petitioner was solemnized with the deceased in the year, 2011.

Although there is allegation that petitioner and his family members made illegal demand and subjected the deceased to cruelty but the informant himself admitted in his written report that on 28-07-2014, he got information through his second daughter, Dewanti Devi about the condition of deceased, who was being treated at Banaras Hindu University, Varanasi and died in course of her treatment.

Learned counsel for the petitioner drew my attention

Patna High Court Cr.Misc. No.28197 of 2015 (3) dt.13-10-2015 2/2 towards the postmortem report of the deceased and submits that the doctor could not ascertain the cause of death of the deceased and the viscera was sent for chemical examination. Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Mohania P.S. Case No. 230 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua.
