Petitioner Krishna Kumar seeks bail in Dhansoin P.S. Case No. 104 of 2014 registered under Sections 409 and 420 of the Indian Penal Code.
The petitioner withdrew Rs.
19,90,500/- for completion of different schemes in the Financial Years 2009-10, 2010-11 and 2011-12 but the petitioner did the work only of Rs. 8,23,052/-. The petitioner is alleged to have misappropriated a sum of Rs. 11,67,448/-. The prayer for bail of the petitioner was earlier rejected vide order dated 01.04.2015 passed in Cr. Misc. No. 8968/2015.
The learned counsel for the petitioner submits that the Headmaster of Up-graded Middle School, Kaithhar Kala, Block Rajpur (Buxar) wrote a letter to the District Programme
Patna High Court Cr.Misc. No.21560 of 2016 (2) dt.14-09-2016 2/2 Officer, Sarva Shiksha Abhiyan, Buxar that the petitioner has returned the money of Sarva Shiksha Abhiyan and also completed the half constructed building. The petitioner undertakes to complete the entire works within three months from the date of his release. The petitioner is in jail since 06.01.2015. The petitioner has already remained in jail for 20 months.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in Dhansoin P.S.
