In view of the recent decision of a Division Bench that writ applications are not maintainable as such in relation to the dispute of a private managing committee, especially of an affiliated college in question and the nature of the dispute raised by the petitioner falls within the realms of the said Division Bench's decision, therefore, the remedy for the petitioner would lie before a civil court of competent jurisdiction and not under Article 226 of the Constitution of India.
Patna High Court CWJC No.3348 of 2014 dt.07-09-2015 2/2 In view of the same, I. A. No. 5465 of 2015 is rejected.
Even the writ application is dismissed with liberty to the petitioner to move a civil court of competent jurisdiction or any other forum.
