2. The petitioner is aggrieved by the order dated 11.05.2017/15.06.2017 passed by the Registrar, Co-operative Societies, Bihar, Patna in the matter of dissolution of the

Patna High Court CWJC No.11130 of 2019 dt.25-11-2019 2/2 Managing Committee of Keshopur PACS in Ekangarsarai Block of Nalanda district on the ground of financial irregularities.

3. Learned counsel for the petitioners submitted that during the inquiry conducted on the order of the Registrar, irregularities have been established but still by the order impugned, the case has been dismissed.

4. Learned counsel for the State submitted that against the said decision, there is statutory appeal under Section 40(3) of Bihar State Co-operative Societies Act, 1935 (hereinafter referred as 'Act'), to the State Government which the petitioner ought to have availed before this Court.

5. Having regard to the aforesaid, the application stand disposed off with liberty to the petitioner to file appeal under Section 40(3) of the Act. If such appeal is file within one month from today, the same shall be disposed off on merits, in accordance with law.
