JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 24-03-2023 Learned counsel for the petitioner undertakes to remove the defects, if any, within two weeks from today. Subject to above undertaking, this Court has heard learned counsel for the petitioner and learned counsel for the State.

In view of the statements made in the writ application that the petitioner is going to retire on 30.04.2023, this Court finds no reason to entertain this writ application. Learned counsel for the petitioner submits that petitioner has already joined at his transferred place. It is submitted that his salary for the month of January and February 2023 have not been paid so far.

A counter affidavit has been filed on behalf of the

Patna High Court CWJC No.14105 of 2021(2) dt.24-03-2023 2/2 State. The order of transfer has been defended by the respondents. In the given facts and circumstances of the case since the challenge to the order of transfer has become infructuous, no order need be passed on this point. So far as the issue of payment of salary for the month of January and February 2023 is concerned, let the District Magistrate, Samastipur consider the same and release the amount admitted on account of salary to the petitioner within a period of 30 days from the date of receipt/production of a copy of this order. This Writ Application stands disposed of.
