Petitioners apprehend their arrest in a case registered for the offence punishable under Sections 420/34 and other allied sections of the Indian Penal Code.

Petitioner no.1 is proprietor of Raja Traders and petitioner no.2 is proprietor of Ganpati Traders. It is submitted that petitioner no.1 has returned the alleged misappropriated amount of Rs.1,86,000/- vide cheque no. 000402 dated 21.1.2021 (Annexure 2) to the informant, whereas petitioner no.2 has returned the alleged misappropriated amount of Rs.92,000/- vide cheque no. 000363 dated 22.1.2021 to the informant, pursuant to which compromise petition (Annexure 3)

Patna High Court CR. MISC. No.35585 of 2022(2) dt.01-11-2022 2/2 has also been filed by the parties. Petitioners have got no criminal antecedent.

Considering the nature of allegation against the petitioners, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate III, Sikrahana at Daka, East Champaran in Ghorasahan Jitna Police Station Case No. 13 of 2021, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
