JUSTICE PURNENDU SINGH ORAL ORDER 17-03-2023 No one appears on behalf of the petitioner, however, Mr. Mahendra Prasad Verma, AC to SC 20 is appearing on behalf of the State, who informed this Court that grievance of the petitioner is with regard to payment of dues and benefit of Sixth Pay Revision.

2. Considering the statements made on behalf of the petitioner, respondents and the State as well as the record, it appears that the petitioner had initially joined as Treasurer in the Department of Housing Construction Circle No.1 (Bhawan

Patna High Court CWJC No.15372 of 2017(5) dt.17-03-2023 2/3 Nirman Vibhag), Patna on 04.12.1974 and subsequently his service was regularized in the year, 1984. The petitioner retired on 28.02.2009. He has already been sanctioned total amount of GPF amounting to Rs.4,32,063 (vide letter dated 15.07.2014) and Rs.1,87,824/- (vide letter dated 15.07.2022) along with upto-date interest.

So far as the grievance of the petitioner with regard to revision of his pension as per the Sixth Pay Revision and payment of total amount with statutory interest and benefit of Time Bound Promotion along with ACP and giving out notional promotion to the petitioner is concerned, specific statement has been made in the Counter Affidavit filed on behalf of the respondent no.3 that the Departmental Screening Committee took a decision to give benefit of ACP to the petitioner w.e.f. 9.8.1999 and the same was communicated to the petitioner, vide order no.82 dated 24.08.2018. It has further been stated in paragraph no.10 of the Counter Affidavit filed on behalf of the respondent no.3 that all retiral benefits have already been paid to the petitioner including GPF, Gratuity, Leave Encashment and Pension etc.

4. This Court finds that the grievance of the petitioner has already been redressed and if the petitioner is aggrieved that
