2. Learned counsel for the petitioners submits that the petitioner have filed the present writ petition for issuance of a direction to respondent No.2 to dispose Mutation Case No. 8039 of 2018-19, but in the counter affidavit, filed on behalf of respondent No.2, in paragraph no.4, it has been mentioned that

Patna High Court CWJC No.96 of 2019(3) dt.11-09-2023 2/2 Mutation Case No.8039 of 2018-19 has already been disposed of on 11.04.2019. As such, he seeks permission to withdraw the present petition with liberty to the petitioners to prefer appeal against the order passed in the aforesaid mutation case.

3. In this background, this writ petition stands disposed of granting liberty to the petitioners to avail statutory remedy of appeal before the appropriate authority.

4. Delay, if any, in filing the appeal is hereby condoned.
