The petitioner is in custody in a case registered under Sections 147, 148, 149, 302, 120(B) and 380 of the Indian Penal Code and Section 27 of Arms Act.

The allegation against the petitioner is of assaulting the informant on her head by Nalkatua causing head injury. On behalf of the petitioner, it has been submitted that the petitioner is in custody since 25.05.2015. It is further submitted that the petitioner has got no criminal antecedent.The main allegation is against Harendra Rai, Akhleshwar Rai and Baleshar Rai causing injury upon the deceased. The allegation against the petitioner is of causing injury upon the informant with the butt of

Patna High Court Cr.Misc. No.28794 of 2015 (3) dt.28-07-2015 2/2 Nalkatua (country made pistol). There is no allegation of causing injury upon the deceased.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Muzaffarpur in Hathauri P.S.Case No. 14/2012.
