2. The petitioner is in custody since 18.09.2015 in connection with Gamhariya P.S. Case No. 104 of 2015 for the offences alleged under Sections 147, 148, 323, 379, 354, 427, 307, 504 and 506 of the Indian Penal Code.

3. It is submitted that the petitioner has been falsely implicated in the backdrop of land dispute between the parties. There is case and counter case. Except the petitioner having been named in the F.I.R. no overt act of assault whatsoever has been attributed to him. Petitioner's case stands on better footing than co-accused Md. Anwar who has been granted bail in Criminal Miscellaneous No. 45886 of 2015.

4. Having regard to the entirety of the facts and

Lalo @ Lal Mohammad be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge, Ist, Madhepura in Sessions Trial No. 112 of 2015 arising out of Gamhariya P.S. Case No. 104 of 2015.
