JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 06.02.2016 in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code.

Neither petitioner is named in the first information report nor anything appears to have been recovered from his conscious possession. The petitioner has not been put on Test Identification Parade and it appears that except confessional statement of co-accused as well as criminal antecedent of the petitioner, there is nothing against him.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.20528 of 2016 (2) dt.19-05-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 118 of 2015.
